3. Purpose and legal basis of data processing

We process your personal data in order to carry out your application process, in particular to:

  • Review your application

  • communicate with you,

  • make a decision about establishing an employment relationship.

If you expressly consent to your application being stored for future job vacancies, we will also process your data for this purpose.


The legal bases are:

  • Art. 6 (1) (b) GDPR – Implementation of pre-contractual measures
  • Art. 6 (1) (f) GDPR – Legitimate interest in an efficient application process within our group of companies
  • Art. 6 (1) (a) GDPR – (Consent), if you voluntarily provide us with additional data or agree to be included in an applicant pool
  • § 26 BDSG (Federal Data Protection Act) (where applicable) – Processing for the purposes of the employment relationship
4. Categories of personal data

We process all data that you provide to us in connection with your application, in particular:

  • Contact details (name, address, telephone number, email) 

  • Resume, references, qualifications 

  • Any other voluntary information (e.g., application photo)

  • Communication content (e.g., emails)

We only process special categories of personal data (e.g., health data) if you voluntarily provide us with this information and there is a legal basis for doing so.


5. Origin of the data

We usually receive personal data directly from you..
In addition, data may come from the following sources:

  • Recruitment agencies or recruiting agencies (with your consent)
  • Publicly accessible professional networks (e.g., LinkedIn, XING), provided your profile is public
  • Recommendations (“employees recruit employees”), provided you have consented to the transfer
6. Recipients of the data

Within our group of companies, only those persons involved in the application and selection process will have access to your data. It may be necessary to pass on your application data to other companies in the FINNOFLEET Group if this is necessary to decide on the establishment of an employment relationship or to check your suitability for alternative positions. The legal basis for this is Art. 6 (1) (b) GDPR, § 26 BDSG (Federal Data Protection Act) and Art. 6 (1) (f) GDPR (legitimate interest in efficient applicant management and filling positions within the group).


To carry out the application process, we also use the Personio recruiting platform (Personio SE & Co. KG, Munich), which processes your data exclusively in accordance with our instructions within the framework of order processing in accordance with Art. 28 GDPR. For more information on the processing of personal data by Personio, please refer to the section “Processing of (personal) data by the operator of the recruiting site.”


Your data will not be passed on to other third parties outside the group of companies unless there is a legal obligation to do so or you have given your consent.


7. Data transfer to third countries

Your personal data may be transferred to Switzerland, as two of our affiliated companies are based there and may be involved in the application process.
The European Commission has issued an adequacy decision for Switzerland in accordance with Art. 45 GDPR. This means that data protection standards in Switzerland are comparable to those within the EU. 


8. Duration of storage

  • Your application data will generally be deleted 6 months after completion of the application process. 

  • Longer storage will only take place if you have given your explicit consent (e.g., 12 months for an applicant pool, or as specified in the consent form) or if there are legal retention obligations.

9. Your rights

You have the following rights with regard to your personal data: 

  • Right to information (Art. 15 GDPR),

  • Right to correction (Art. 16 GDPR),

  • Right to deletion (Art. 17 GDPR),

  • Right to restriction of processing (Art. 18 GDPR),

  • Right to data portability (Art. 20 GDPR),

  • Right to object to processing (Art. 21 GDPR), 

  • Right to withdraw consent (Art. 7 (3) GDPR).

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website.
